Fortified Health Inc., doing business as Whole in One Health, (“W1,” “We,” “Our,” or “Us”) values your privacy and is committed to protecting the privacy of Our users of alzmeter.com (the “Site”) and the Alz Meter mobile application (the “App”). W1 offers a variety of content and services through the Site, App. and Store (collectively, the “Services”). This Privacy Policy explains how We collect, use, and protect your personal information (“Personal Data”). We encourage you to read this Privacy Policy as well as our Terms and Conditions found at www.alzmeter.com/help-center/terms-and-conditions (“Terms”).

W1 and all associated Services and systems, including registration, are housed on servers in the United States. If you are located outside of the United States, please be aware that information We collect (including cookies and device data) will be processed and stored in the United States, a jurisdiction in which the data protection and privacy laws and principles, including your data subject rights, may not offer the same level of protection as those in the country/region where you reside or are a citizen. By using Our Services and providing information to Us, you consent to the transfer to and processing of the information in the United States and, unless otherwise stated in this Privacy Policy, We use this consent as a legal ground for that data transfer. You may be asked for your explicit consent to this data transfer as part of account creation.

Note to Residents of the European Union: In order to comply with the requirements of the European General Data Protection Regulation (GDPR) for our European consumers and users, this Privacy Policy outlines the legal bases on which we process your Data and provides other information required by the GDPR. Further country/region specific information for Our European users is outlined in section 6a.

Please read this Privacy Policy carefully, as your access to and use of the Services signifies that you have read, understand, and agree to all terms within this Privacy Policy. If you do not agree with any part of this Privacy Policy or Our Terms, please do not access or continue to use any of the Services or otherwise submit your Personal Data to Us.

  1. Personal Data

    Personal data (“Personal Data”) is information that can be used to identify you, directly or indirectly, alone or together with other information and includes Fitness and Wellness Data (as defined in section 2b).

    We may create de-identified or anonymous data from your Personal Data by excluding the data components (such as your name, email address, or linkable tracking ID) that make the data personally identifiable as you, through obfuscation, or through other rigorous means. Our use of anonymized and de-identified data is not subject to this Privacy Policy but is consistent with applicable data protection laws and regulations and the data is not used in a way to harm individuals.

  2. Purpose of Collecting Information

    2a. When you register for an account or interact with our Services
    W1 collects Personal Data when you use or interact with our Services, including when you register for an Alz Meter account, purchase Premium Services (as defined in 7a of Terms), or otherwise use the Services (e.g., browse the content available on the Services), and when you ask us to customize our Services. This Personal Data may include full name, photo, age, date of birth, gender at birth, email address, phone number, username and password, payment information, certain cookies and network identifiers.

    2b. When you input Fitness and Wellness Data manually or use or interact with a connected device or app
    “Fitness and Wellness Data” is a type of Personal Data that includes the data that you provide via manual entries but also the data collected from Apple Health, Google Fit and any other information source that you elect to connect with the Services. Fitness and Wellness Data can include data related to your fitness activity, sleeping data, cognitive challenge and learning data, diet data, social data, stress level and stress management data, height, weight and weight measurements, heart rate, blood pressure data, glucose data, cholesterol data, hearing and vision data, biometric data, diagnoses, symptoms, and a variety of other health metrics. We collect Fitness and Wellness Data to provide the Services and to tailor features, advertising, and services to your interest and goals, including lesson recommendations, coaching, reporting and analytics, lifestyle suggestions, and product recommendations.

    When you use a device that is connected to the Internet, such as heart rate monitors, activity trackers, and other wearables that integrate with the Services, we collect Fitness and Wellness Data to enhance your experience with the Services. We may also collect certain information about the device or product such as serial number, Bluetooth address, UPC, or other device-related information.

    2c. When you communicate with us, or sign up for promotional materials
    We collect Personal Data when you communicate with us or sign up to receive promotional materials or information (“Messages”) via email and push notifications. When you sign up for a new account, you are consenting to receive Messages. You may change your election within the App, at Profile; Settings.

    As long as your election is set to receive Messages, we may use your Personal Data and other information to communicate with you about the Services you have purchased or used; provide you with promotional messages and personalized advertising; notify you of other features and promotions; notify you of Services we think may be of interest to you; and, for other marketing purposes. You can manage your communication preferences in your account settings within the App at Profile; Settings.

    2d. When you engage with our online communities
    We may collect your Personal Data when you engage with our online communities. This includes when you click on advertisements, interact with our social media pages, submit content, or otherwise enter information into comment fields, blogs, or community forums sponsored by or affiliated with the Services.

    2e. When you access third party products and services
    We may allow you to register and pay for third-party products and services or otherwise interact with another website, mobile application, or Internet location (collectively “Third Party Sites”) through our Services, and we may collect Personal Data that you share with Third Party Sites through our Services.

    2f. When we leverage and/or collect cookies, device IDs, location, data from the environment, and other tracking technologies
    We may collect Personal Data using cookies and other technologies such as device IDs, advertising IDs, geolocation, HTML5 local storage, Flash cookies, and IP addresses. We specifically use browser cookies for different purposes, including cookies that are strictly necessary for functionality and cookies that are used for personalization, performance/analytics, and advertising.

    2g. When we aggregate or centralize data
    We aggregate and centralize Personalize Data for purposes of analytics, innovation, and to provide enhanced services to our users.

    2h. When we provide you geographically relevant Services, offers, or advertising
    We may use general location data to provide you Services, offers or advertising that are relevant to your general location.

    2i. When you ask us to customize our Services
    We use photos, videos, and other Personal Data to customize our Services to you.

    2j. When we comply with legal requirements or obligations, law enforcement, and for public safety purposes
    We may use Personal Data in order to comply with laws, regulations, court orders, or other legal obligations, or to assist in an investigation, to protect and defend our rights and property, or the rights or safety of third parties, to enforce our Terms, this Privacy Policy, our Data Use policy, or agreements with third parties, or for crime-prevention purposes.

  3. Data Sharing

    Your Data is YOUR Data. We do not share your personal information with third parties without your consent, except as described below:

    3a. Third-Party Service Providers
    W1 may use third-party service providers to assist with various aspects of its operations (“Vendors”), including, but not limited to, payment processing, marketing and communications. For example, W1 may use a third-party email marketing service to send promotional emails to users who are opted in to receive them. W1 takes reasonable steps to ensure that any third-party service providers it engages with are reputable and comply with applicable privacy and data protection laws.

    By using the Site and/or App, you acknowledge and agree that W1 may share your Data with its vendors for the purpose of providing and improving the Services.

    3b. Legal Disclosure of Data
    W1 may disclose your Data if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright law), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement activity.

    W1 also reserves the right to disclose your information that we believe, in good faith, is appropriate or necessary to take precautions against liability; to protect W1 and others from fraudulent, abusive, or unlawful uses or activity; to investigate and defend ourselves against any third party claims or allegations; to assist government enforcement agencies; to protect the security and integrity of the Services; or to protect the rights, property, or personal safety of W1, our users, or others.

  4. Data Security

    We take reasonable measures to protect your personal information from unauthorized access, use, and disclosure. We use access controls to protect your data.

    We use certain physical, managerial, and technical safeguards consistent with those used to protect health records and that are designed to improve the integrity and security of your Data. However, W1 also cannot guarantee that such Data may not be accessed, disclosed, altered, or destroyed by unauthorized breach of any of our physical, technical, or managerial safeguards.

    If W1 learns of a security breach, we will attempt to notify you electronically so that you can take appropriate protective steps. W1 will post a notice on the Services if a security breach occurs.

    4a. Security Through Third-Party Services
    W1 takes reasonable measures to ensure that your personal data is transmitted securely to its Vendors, using industry-standard security protocols. However, please be aware that no method of transmission over the internet or electronic storage is 100% secure, and W1 cannot guarantee the absolute security of your Data.

    4b. Privacy Settings
    Although W1 may allow you to adjust your privacy settings to limit access to your Data, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you may choose to share your Data. Therefore, if you choose to post information using social media, we cannot and do not guarantee that information you post on the Site and App will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site and App. You understand and acknowledge that, even after removal, copies of Data that you have posted may remain viewable in cached and archived pages or if other users have copied or stored such Data.

  5. User Rights

    5a. Data Sharing

    You may, of course, decline to share your Data with W1, in which case W1 will not be able to provide to you some of the features and functionality found on the App and Site. To use the App and/or Site while limiting your risk of disclosure of Data that may be identified as yours, you can use the Apps and disclose an email address that cannot be linked to you. W1 will not be responsible if such email address is traced to you by other parties.

    5b. Data Deletion

    You have the right to request the deletion of your personal data held by W1 at any time. Open the App, navigate to Profile, choose Settings, select Delete/Disable Account and follow the prompts. We may retain certain data as required by applicable laws or for legitimate business purposes, where permitted by applicable laws, even if your personal data is deleted. Your data may remain in system backups for a limited period.

  6. Legal Requirements

    W1 complies with applicable data protection laws, such as the General Data Protection Regulation (GDPR) if you are located in the European Union (EU) and the General Data Protection Law (LGPD) if you are located in Brazil.

    6a. Residents of the European Economic Area and United Kingdom
    6ai. If You Elect Not to Provide Personal Data
    You may choose not to provide W1 with your Personal Data. However, if you choose not to provide your Personal Data, you may not be able to enjoy the full range of Services.

    6aii. W1 takes steps to keep your Personal Data accurate and up to date. If you reside in the European Economic Area, you have certain rights to the Personal Data that we have collected about you. To exercise your rights to your Personal Data, please contact us at support@alzmeter.com. Subject to applicable law and in exceptional circumstances only, we may charge for this service and we will respond to reasonable requests as soon as practicable, and in any event, within the time limits prescribed by law

    6b. Residents of Brazil
    6bi. Legal Basis for Processing
    We may rely on consent and/or other valid legal bases to process your Personal Data. Such legal bases may include: the legitimate interest of the controller or third party; for compliance with a legal or regulatory obligation by the data controller; for the execution of a contract; for regular exercise of rights in court, administrative or arbitration proceedings.

    6bii. How to Exercise Your Rights
    W1 takes steps to keep your Personal Data accurate and up to date. If you reside in Brazil, according to the LGPD, you have certain rights to the Personal Data that we have collected about you. To exercise your rights to your Personal Data, at any time, please contact us at support@alzmeter.com. Your request will be fulfilled at no cost, and we will respond to reasonable requests as soon as practicable, and in any event, within the time limits prescribed by law.

  7. Age Restrictions

    Protecting the privacy of young children is especially important to W1. For that reason, W1 does not knowingly collect or maintain personally identifiable Data on Services from persons under 13 years-of-age, and no part of the Services is directed to persons under 13.

    IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SERVICES AT ANY TIME OR IN ANY MANNER.

    If W1 learns that personally-identifiable Data of persons less than 13 years-of-age has been collected on W1 without verifiable parental consent, then W1 will take the appropriate steps to delete this Data.

  8. Changes to this Privacy Policy

    We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated Privacy Policy on our website or by sending you an email.
    This Privacy Policy may be revised periodically without further notice to you and this will be reflected by a “Last Modified” data below, if applicable. Please revisit this page to stay aware of any changes.

    In general, we only use your Data in the manner described in the Privacy Policy in effect when we receive that personal information. Your continued use of the Site and App constitutes your agreement to this Privacy Policy and any future revisions
